1. The terms and conditions set out below constitute a binding agreement between “The Customer “and “ShrinkMaster Ltd” to purchase services. These terms and conditions of service may only be modified, altered or amended in writing signed by both The Customer and ShrinkMaster; any attempt to unilaterally modify, alter or amend same shall be null and void.
2. In these conditions ‘SM’ refers to ShrinkMaster and ‘The Customer’ refers to any person, company or corporation that makes use of the services of ShrinkMaster. If the Client comprises more than one person, each person’s liability will be equal.
3. SM shrink wrap is NOT guaranteed to withstand the following factors:
- a. Wind or wind gusts greater than 60km per hour unless otherwise agreed / quoted.
- b. Any adverse weather conditions that are deemed by the New Zealand Weather Bureau or met service to be severe.
- c. hurricanes, tornadoes, cyclones and any other irregular weather pattern. Or natural disasters.
- a. SM will not be held liable for any modification of ANY parts of the shrink wrap system carried out by a person or persons not employed or contracted by SM.
- b. SM will not be held liable for any damage to the shrink wrap application as a result of vandalism or negligence.
- c. SM cannot guarantee welds where previously applied wrap and new wrap are being joined.
- d. Upon any one of the above occurring all future work at the site will be deemed billable.
- e. Scaffolding or roof structure to support shrink wrap with less than 12 degrees pitch.
- f. Scaffolding with purlins spaced greater than 1.5m
- g. Mono pitched roof spans of more than 15m
4. The Customer agrees to provide a safe work environment for the employees and contractors of SM.
- a. When the Customer supplies their own scaffolding, The Customer accepts all liability for the scaffolding structure and agrees to protect SM against any claims regarding the scaffolding including but not limited to, damage to the scaffolding or third-party property.
- b. The Customer agrees that SM reserves the right to request changes to the scaffolding before shrink wrap is applied if the Customer provides their own scaffolding.
- c. The scaffolding has been built to support the wind loadings once shrink wrap is applied.
- d. Access must be provided, where it is expected for employees of SM or contractors to stand on any roof area of a property, The Customer agrees to provide working platforms if required.
- e. SM cannot be responsible for any damage to roof areas including broken tiles or damaged roofing iron etc.
- f. Shrink wrap that is not fit for recycling will not be removed by SM. Additional costs may be charged for disposal of, but not limited to the following: Contamination from cement/ concrete splatter, paint, asbestos or plaster.
- g. A tear down/removal will be carried out in one visit or “stage” multiple visits to remove in sections will occur additional charges
5. SM supplied Scaffolding
5.1. All scaffolding equipment left on a site will be the full responsibility of the customer to ensure and protect against theft or vandalism. The customer agrees to replace any missing or stolen scaffolding equipment at replacement value
6. Any changes to the work quoted or being charged out must be agreed upon by SM and The Customer in writing. The final invoice will reflect any adjustments made by either SM or The Customer.
7. Any disputes must be raised within 14 days of receiving our invoice. This includes any claims for damages.
8. The Customer agrees to limit ALL claims and or liability to the value of services rendered.
9. Indemnification/Hold Harmless. The Customer agrees to indemnify, defend and hold SM harmless from any claims and/or liability arising from the use our services.
10. Both parties agree that unless agreed in writing no retentions will be held.
11. The Customer agrees to pay in full for services carried out by SM as quoted. If payment is not made by the due date, interest of fifteen per cent will be added to the amount owed every month until payment is made. The Customer shall pay any expenses and charges including legal costs that are incurred whilst recovering any money owing to SM.
12. All care will be taken on or around roofs, however it is agreed that we are not responsible or liable for any loss or damage caused to roofs or buildings resulting from scaffolding equipment and/or scaffolding equipment provided by us or damage caused by us during the install or dismantle process.
